LONG BEACH, Calif.--(BUSINESS WIRE)--Today, the City of Long Beach, Gomez Trial Attorneys, and Baron & Budd

filed the seventh lawsuit of its kind against Monsanto for PCB

contamination of Long Beach's city storm water and the Port of Long

Beach. Polychlorinated biphenyls, or PCBs, are toxic chemicals which

cannot be contained and last for decades. PCBs off-gas from their

original application, enter into city storm water through urban run-off,

and deposit into the Port of Long Beach.

Long Beach joins San Jose, San Diego, Seattle, Oakland, Berkeley, and

Spokane, all which have filed similar lawsuits against Monsanto. The

case was filed in federal district in the Central District of

California, Case No. 2:16-cv-03493.

Monsanto produced PCBs for approximately 50 years until the U.S.

Congress banned them because they endanger human and environmental

health. Despite the 1979 ban, today PCBs are a common environmental

contaminant found in all natural resources including water and plants as

well as tissues of marine life, animals and humans. PCBs bioaccumulate

in the food chain and are associated with illnesses and cancer in humans.

"The City is committed to holding Monsanto responsible for the

significant amount of contamination it has placed into the City's

eco-system and Monsanto should shoulder the burden of cleaning up the

environment, not the taxpayers of Long Beach and the State," says City

Attorney Charles Parkin. "Long Beach is standing up for clean water and

holding Monsanto responsible for producing and distributing products in

knew would become a significant risk to the environment."

"Monsanto unleashed an environmental virus that cannot be contained and

is now in virtually every living organism in our food chain," says Baron

& Budd attorney Scott Summy, who leads the litigation for each of the

seven cities. "Long Beach is standing up for clean water and holding

Monsanto responsible for manufacturing a product it knew would become a

global contaminant."

"PCBs are found in the consumable tissue of fish and other wildlife.

Monsanto's PCBs are one of the largest public nuisances on the planet,"

says attorney John Fiske of Gomez Trial Attorneys. "It's unfair that

Long Beach taxpayers and cities are stuck cleaning up Monsanto's mess."

During the five decades prior to the 1979 ban, Monsanto's PCBs were

incorporated into a wide variety of products and applications including

power transformers, electrical equipment, paints, caulks and other

building materials. Monsanto knew that PCBs were toxic and could not car accident attorney be

contained as they readily escaped into the environment, finding their

way into bays, oceans, lakes, rivers, streams, soil and air. Although

documents show Monsanto recognized PCBs were becoming a global

contaminant, Monsanto continued to manufacture PCBs and ignored the

health risks to humans and the environment.

California's Water Quality Control Board has determined that the

presence of PCBs in storm water runoff in Long Beach threatens fish and

wildlife in the Port of Long Beach. Long Beach will continue to incur

significant costs related to PCBs in its storm water and the sedimentary

deposits in Port of Long Beach and adjacent ocean floor areas.

Gomez Trial Attorneys, based in San Diego, represents cities and

families in water contamination cases. Baron & Budd, P.C., based in

Dallas, Texas, has represented hundreds of public entities nationwide

whose water supplies, properties or natural resources are affected by

chemical contaminants.

"Many of the suspects who are caught in sting operations have been unable to get a contractors license because of a criminal background."

- Steve Sands, Registrar, CSLB (Contractors State License Board)

A contractor's job is highly hectic and requires you to possess all the related skills. Contractors work on different construction jobs, often starting out as foremen, journeymen, supervisors, etc. Many of them work on small-time projects, without a license, which gives them a lesser salary and status. In the state of California, the CSLB requires that contractors working on projects costing more than USD 500 be licensed. Many are unaware of this, and continue their jobs without a license. The ones with a related degree are known to apply sooner and stay on the top, demanding high charges. In order to be in the same league, learn how to get a general contractor license in California.

Requirements

General Requirements

You must be more than 18 years of age.

You must pass the required State Contractors examinations.

You must a file a bond of USD 10,000 with the Registrar.

You must have a working capital of USD 2,500, to say the least.

Education and Experience

You are required to have a work experience of at least 4 years.

This experience could be in any building trade, like a foreman, supervisor, subcontractor, etc.

With regards to education, a 4-year degree program in the disciplines of either Physics, Mathematics, Business, Accounting, etc., is a sound choice.

If you have this degree, a work experience of 2 years will be sufficient too.

Actually, to get this license, the work experience holds more importance than the degree, as with experience, you can rise up the ladder eventually.

Procedure

If you satisfy the requirements as stated above, you can get a pre-approval from the State to give the exam, which is the main step in obtaining the license.

Step I

To begin with, you need to fill up the application form.

The application form costs around USD 300 and has to be obtained from the California Contractors State License Board.

It can be downloaded from here as well.

Fill up the form accurately, with the correct, legal information.

Step II

Arrange your documentation properly.

Collect all the required certificates, documents, forms, credit reports, liability insurance, etc., and file them neatly.

This needs to be submitted along with your form.

Step III

You will be informed by the Board once your application is approved.

You will be given a suitable date for your exam.

Pay up all the fees. Your exam fee is included in the application fee.

Your license fee is around USD 180.

You also have something called a license bond, which would cost you around USD 100 to USD 120, if you have a good credit rating.

Step IV

Now you are all set to give the exam.

Actually, you are supposed to give 2 papers - the standard business test and another test that grades you on your classification.

Your exam paper will contain questions related to topics, like structure, safety, plans, estimation, core trade, etc.

You will have to obtain 72% in order to pass the test.

In addition, you will have to give the open book asbestos abatement exam.

Step V

You must be wondering how long it takes to get a contractor license in California. This depends on how long it takes for your application to get processed.

You can also check the application status online.

Once you receive your acknowledgement and give the exam, the license is issued shortly thereafter.

Points to Remember

There are different application procedures for qualifying individuals, corporations, LLCs, etc.

Your license will be issued based on three classifications:Class 'A' is labeled as a 'General Engineering Contractor' and includes specialized engineering skill.

Class 'B' is labeled as 'General Building Contractor' and includes the technical know-how of the building and structure trade.

Class 'C' is labeled as 'Specialty Contractor' and includes unique building trades and skills.

You are required to have separate certifications for each classification, or if you are going to be working on hazardous substances.

A degree is not compulsory, but experience is, and if you have completed vocational school training or undertaken an apprenticeship program, the required certificates need to be included.

A joint venture license (if you have applied for one) expires within 2 years.

If your application is rejected, you have to apply again within 3 months.

Being a contractor is not an easy job, your profile requires you to resolve multiple tasks in the construction business. Contractors with a license earn much more than those without one, and this process, though time-consuming, is essential in order to rise up the ranks and be in charge of bigger projects. A recent survey deduced that licensed contractors in California earn around USD 70,000. So, if you are one of those contractors who has renovation project still not obtained a license, try to secure projects of more than USD 500 and quickly start the application process. Being licensed gives you a status, a credibility, and the legal right to charge more for your work.

1. Mold Resistant Wood: Another great choice for preventing mold is mold resistant wood. Companies like Frame-Guard manufacture wood that has been treated with anti-mold chemicals. In addition to staving off mold, this product also keeps termites away. Another great attribute of this product is that Frame-Guard wood is certified by Greenguard to not release any harmful emissions into the air.

2. Mold Resistant Insulation: Even though fiberglass is inherently resistant to mold, there are companies producing insulation that has been treated with a fungicide. Companies like Nu-Wool manufacture a Premium Cellulose Insulation that is one of the few insulation products which contains a fungicide registered by the Environmental Protection Agency (EPA). In addition, the fungicide being used by Nu Wool is low in toxicity making it a safer choice when considering treated insulation.

3. Mold Resistant Drywall: This type of drywall has fiberglass facing instead of the traditional paper facing. The use of fiberglass removes the organic material aspect from the drywall (mold feeds on organic material). Even though mold resistant drywall does not completely prevent mold growth, it greatly reduces occurrence. Top mold resistant drywall brands include U.S. Gypsum (Sheetrock Brand new home Humitek) and Georgia Pacific (DensArmor Plus).

4. Mold Resistant Drywall Tape: Providing more protection against mold than paper tape, mold resistant drywall tape is the ideal tape to compliment to mold resistant paperless drywall market. One brand, FibaTape a, produces a tape that is covered by an anti-microbial coating; their tape achieved a perfect 10 rating on the ASTM D3273 mold test.

5. Mold Resistant Paint: More and more, there are paints being offered that contain fungicides. The point of using a mold resistant paint is to discourage the growth of mold on the paint surface (the wall). However, it should be noted that if there is already mold present before the paint is applies, the paint will not kill the mold; any mold must be removed at its source before paint is applied. An example of a great mold resistant paint is Perma-White by Zinsser. It is guaranteed to prevent the growth of mold on the paint film for at least 5 years as shown in independent laboratory tests.

6. Mold resistant Stucco: Mold conscious builders now have a choice when it comes to exterior finishes. Mold resistant Stucco, such as Amerimix Water, Mold & Mildew Resistant, offers excellent protection against mold and offers double-duty protection against water damage. Mold resistant Stucco is pre-blended with a waterproofing and anti-microbial product, and is easily found at stores like Home Depot.

7. Mold Resistant Carpet: Carpets made of Olefin (polypropylene) fibers or acrylic fibers offer resistance to mold growth, although, acrylic carpets are being less used in todays market because of their poor resilience. Polypropylene carpets can be found almost anywhere today.

8. Mold Resistant Caulk: On the market, this tends to be sold as Mildew Proof or Mildew Resistant caulk. Because mildew isnt necessary the mold you see in your home, (See The Difference Between Mold and Mildew), we choose to call it Mold Resistant Caulk.Manufacturers like Dap have introduced products like Kwik Seal Plus Adhesive Caulk with Miocroban. The caulk is treated with fungicide so it helps prevent mold growth on the caulk as well as stains and odors. In addition, the caulk emits low VOCs.

9. Mold Resistant Sealant: Easily applied to wood, OSB, concrete, stucco, brick, tile, gypsum, and other surfaces in the home, mold resistant sealant is a protective coating that has been blended with anti-microbial chemicals. Mold resistant sealants come in either spray or non-spray forms. Brands like Fiberlock IAQ 6040 Mold Resistant Sealant can be used on wood, OSB, wallboard, concrete and other construction materials to withstand the moist, humid conditions that provide the ideal environment for fungal growth.

10. Mold Resistant Shower Pan: A great alternative on the market is the Tile Redi Barrier Free Black Shower Floor. Claiming to be the best water intrusion solution available, Tile Redi produces a shower floor that is ready for tile and is set on the shower pan floor with epoxy. The product is leak free and mold resistant. Tile Redi also states that no further waterproofing will be required with use of their product.

While there are more products being manufactured to help resist mold growth, it is important to note that if there is a mold problem to begin with, the mold must be removed at its source. Nevertheless, mold resistant building materials provide great building blocks for a mold-free property and help prevent having to endure the process of mold removal. Especially when used in high-humidity and mildew-prone areas, mold resistant materials can significantly increase indoor air quality as well as help maintain a mold-free environment.
